These Terms of Service apply when you visit obsidianbio.ca or purchase products from Auralith. In these terms, “Auralith,” “we,” “us,” and “our” refer to Auralith / Obsidian Bio, based in Alberta, Canada.
By accessing our website or placing an order, you agree to these terms and to our Privacy, Shipping, and Refund policies.
PRODUCT INFORMATION
Auralith products are cosmetic products intended for external use only. Product descriptions are provided for general cosmetic and informational purposes. Our products are not intended to diagnose, treat, cure, or prevent any disease or medical condition.
Review the ingredient list before use. Follow the directions supplied with the product. Consider testing a small area before regular use, particularly if you have sensitive skin. Stop using the product if irritation occurs. Seek advice from an appropriate healthcare professional if you have concerns about using a product.
We make reasonable efforts to present product colours, packaging and information accurately. Screen settings and small-batch production may result in minor differences in appearance.
ORDERS
Submitting an order is an offer to purchase. We may accept, reject, or cancel an order for legitimate reasons, including inaccurate information, suspected fraud, pricing errors, unavailable inventory, or an inability to deliver to the supplied address.
If we cancel an order after receiving payment, we will refund the amount paid for the cancelled portion.
PRICES AND PAYMENT
Prices are displayed in Canadian dollars unless stated otherwise. Applicable shipping charges and taxes are shown during checkout.
Interac e-Transfer payments must be sent according to the instructions shown after checkout. Orders paid manually remain unpaid or pending until we confirm receipt of the full payment. Orders are prepared for shipment after payment is received.
Customers are responsible for entering the correct order number or other requested reference with their transfer. Contact info@obsidianbio.ca if you experience a payment problem.
SHIPPING
Shipping destinations, rates, processing times, and delivery information are described in our Shipping Policy. Delivery estimates are estimates and are not guarantees.
RETURNS, REPLACEMENTS AND REFUNDS
Returns, replacements and refunds are governed by our Refund Policy. We do not accept change-of-mind returns for personal-care cosmetic products. This does not limit rights available under applicable consumer-protection law.
ACCEPTABLE USE
You may not use this website to:
• Violate applicable law
• Submit false, misleading or fraudulent information
• Interfere with the security or operation of the website
• Introduce malicious code
• Copy or exploit our content, branding or product materials without authorization
• Attempt to obtain unauthorized access to accounts, systems or information
INTELLECTUAL PROPERTY
The Auralith name, branding, product names, photographs, graphics, written content and other original materials on this website belong to Auralith or are used with permission. They may not be copied, reproduced, distributed, or commercially exploited without written permission.
THIRD-PARTY SERVICES
Our store is hosted by Shopify. We may also use third-party providers for payment processing, shipping, analytics and other store services. Those providers may have their own terms and privacy practices.
DISCLAIMER AND LIMITATION OF LIABILITY
To the extent permitted by law, Auralith is not responsible for indirect, incidental or consequential losses arising from use of the website or products.
Nothing in these terms excludes or limits liability or consumer rights that cannot legally be excluded or limited.
INDEMNITY
To the extent permitted by law, you agree to be responsible for losses reasonably resulting from your unlawful misuse of the website or your material violation of these terms.
CHANGES TO THESE TERMS
We may update these terms to reflect changes to our products, services, operations or legal obligations. The revised terms will be posted on this page with an updated revision date.
GOVERNING LAW
These terms are governed by the laws of Alberta and the applicable federal laws of Canada, without limiting any mandatory consumer rights that apply based on the customer’s location.
SEVERABILITY
If any part of these terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
